How are medical expenses and lost wages compensated in car accident cases?

In car accident cases, medical expenses and lost wages are typically compensated through a combination of insurance coverage and legal claims. Medical expenses are usually covered by the at-fault driver’s insurance, which includes hospital bills, doctor visits, and rehabilitation services. In states with personal injury protection (PIP) or medical payments (MedPay) coverage, medical expenses are covered regardless of fault, and PIP often includes lost wage coverage.

If you have health insurance, it may cover medical costs, though your insurer may seek reimbursement from the at-fault party’s insurance through subrogation. Additionally, healthcare providers may place a medical lien on your case, ensuring their payment directly from your settlement.

Lost wages can also be covered from the at-fault driver’s insurance, covering income, benefits, bonuses, and commissions lost due to the accident. The calculation of lost wages is based on your hourly, daily, or annual salary, multiplied by the time missed from work. In some cases, PIP or MedPay may provide additional lost wage coverage. If insurance does not fully compensate for lost wages, a legal claim may be necessary to recover remaining damages. To ensure full compensation, it is crucial to maintain detailed documentation of medical expenses and lost income.
