What are the chances of my case going to trial versus settling out of court?

It is very likely that your case will not go to trial and will most likely settle out of court. 

  • Reasons for high chance of settlement
    • Insurance companies prefer to settle outside the court to avoid unpredictable verdicts 
    • Plaintiffs want fast compensation. If they were to go to trial, they would be waiting months, even years. 
    • When one side has significantly more evidence than the other, settlement is the best option.
  • Reasons for the low likelihood of a trial
    • Liability is disputed: a jury may need to decide who is at fault
    • The insurance company does not offer a fair settlement
    • Serious injuries or damages took place 
    • There are disputes that need a court’s discretion
