Your Trial Lawyer

Should I accept an insurance settlement without legal advice?

Injury claims are often worth a lot of money, but insurance companies will almost always offer much less than you deserve. Therefore, before accepting a settlement, it’s essential to go to an attorney so you can obtain a fair settlement in exchange for your damages.

Insurance companies are for-profit companies, and their primary goal is to protect their profits, not to fairly compensate plaintiffs. To do this, they may use multiple tactics to pay you less money or deny a legitimate claim altogether.

The insurance adjuster may be friendly, and may even appear sympathetic, but the goal is the same, convince you to take the lowest offer imaginable. The first offer is always too low because it is meant to leave room for negotiation or to pressure you into accepting an offer without knowing the full extent of your damages.

If you take a settlement at the outset, then you might miss getting compensated for future damages, as the initial offer usually only dictates what has already been lost, and/or paid for any medical bills. The insurance company may also push you towards a settlement, by using manipulative words such as “limited time offer”, to rush you into making a fast decision.

In a similar situation, a personal injury attorney will work for you not the insurance company and will be motivated to get every penny out of your claim. Most personal injury attorneys will provide a free consultation for you to understand the real value of your claim before you sign anything. Talking to a lawyer will help you make responsible choices and protect your finances.
