Should I talk to the police without a lawyer present?

No, you should not talk to the police without a lawyer present because: 

  • Every arrested person has the right to remain silent to avoid incriminating oneself. This is afforded by the fifth amendment stating “…nor shall be compelled in any criminal case to be a witness against himself…” 
  • Every arrested person has the right to have a lawyer present, and an attorney is meant to protect such person’s best interest. 
  • An arrested person may say something that makes them sound like or convinces the police they are guilty, even if they’re not.
