Can I travel outside the country while facing criminal charges?

Whether you can travel outside of the country while facing criminal charges depends on certain factors:

  • Misdemeanor vs. felony: if you have been convicted of a misdemeanor, travel restrictions are less common, but you may still need court approval. If you are convicted with a felony, it is much more likely for courts to restrict travel.
  • Bail: if you are out on bail, you may be prohibited from international travel depending on your bail conditions. If out on bail, it is unlikely that you will be able to travel internationally, but some courts may grant you approval. This is to prevent you from trying to flee or escape the charges against you. 
  • Ties to community: courts take community ties as to where your charges are pending into strong consideration. This includes long-term residence, employment, and family ties.
  • Reason for travel: the reason for travel is another important factor that plays a significant role in the court’s decision to allow for international travel. If you are traveling for work or for a family emergency, the court is much more likely to allow for international travel.
