How can prior convictions affect my current case?

Prior convictions can affect a person’s current case quite significantly:

  • Harsher penalties: the court may inflict longer sentences, larger fees, or stricter probation terms. Many states have three-strike laws which lead to mandatory minimum prison sentences or even life sentences.
  • More serious charges: Charges may be enhanced or become more serious with previous convictions. For example, a DUI may become a felony rather than a misdemeanor if it is not your first DUI.
  • Reduced plea options: prosecutors will be less likely to offer a plea deal or might not offer very pleasing terms.
