How does the legal system handle car accident cases involving uninsured motorists?

When involved in an accident with an uninsured driver, your best option is to rely on your own insurance. Uninsured motorist (UM) coverage can help pay for medical bills, lost wages, and car repairs if the other driver lacks insurance. This coverage also applies to hit and run accidents where the at-fault driver is unidentified. Some states require UM coverage, while others make it optional.

Suing the uninsured driver is another option, but it often proves difficult. Even if you win lawsuit, collecting compensation may be challenging if the driver has no assets or income. Some states, like California, limit uninsured drivers’ ability to claim noneconomic damages, even if they were not at fault.

If you lack UM coverage, other insurance options may help. Collision coverage can pay for vehicle repairs regardless of fault, and underinsured motorist (UIM) coverage can supplement an at-fault driver’s insufficient insurance. State assistance programs also exist but are often limited.
