How long do premises liability cases take to resolve?

The time it takes to resolve a premises liability case varies depending on several key factors. While some cases settle within a few months, others can take a year or more, especially if they go to trial.

Here are the main factors that influence the timeline:

  • Liability disputes:  If the property owner disputes responsibility for the accident, the case may take longer as evidence needs to be gathered to establish fault. This includes witness statements, surveillance footage, and expert testimony.
  • Severity of injuries and medical treatment :  Cases involving serious injuries often take longer because it’s important to wait until the injured party reaches maximum medical improvement (MMI). Settling too early could result in compensation that doesn’t fully cover long-term medical costs.
  • Negotiations with insurance companies : Many premises liability cases are resolved through settlements with insurance companies. Negotiations can take time, especially if the insurer initially offers a low settlement that does not adequately cover damages.
  • Filing a lawsuit and litigation : If a fair settlement cannot be reached , the case may proceed to litigation. The lawsuit includes discovery, depositions, pre-trial motions, and potentially a trial. Litigation significantly extends the timeline, often taking a year or more.
  • Court scheduling and delays: If the case goes to trial, court schedules and backlog can also impact the timeline. Some jurisdictions have busier court systems, leading to delays in hearings and trial dates.

While every case is different, straightforward claims with clear liability and minor injuries may settle in a few months, whereas complex cases involving severe injuries or litigation can take over a year.

Consulting with an experienced attorney can help ensure the case is handled efficiently while securing fair compensation.
