What are my rights if I’m being harassed by a coworker?

If you’re experiencing harassment from a coworker, you have legal protections under the Fair Employment and Housing Act (FEHA). This law ensures you have the right to work in an environment free from harassment based on race, gender, disability, or other protected characteristics. These protections apply no just to coworkers but also supervisors and even clients.

If you’re facing harassment, report to your employer or HR as soon as possible. Keep detailed records of each incident, including dates, what was said or done, and any witnesses. Employers are legally required to investigate and take appropriate action to address the situation.

If your employer fails to act, you have the option to file a complaint with the California Department of Fair Employment and Housing (DFEH) or the Equal Employment Opportunity Commission (EEOC). In some cases, you may also have grounds for a lawsuit if the issue remains unresolved. Additionally, California law prohibits retaliation against employees who report harassment. If you experience retaliation, such as demotion or termination, you may have a separate legal claim.
