What is a motion to suppress evidence?

A motion to suppress evidence aims to exclude certain evidence from being presented at trial. This is a legal motion brought before the court and generally based on constitutional grounds made by the lawyer due to evidence being obtained unlawfully (violation of Miranda Rights, 4th Amendment violation, improper conduct, coerced confessions, and chain of custody issues). If the motion is granted, the prosecution’s case is weakened and it can potentially lead to a dismissal of charges or a plea bargain.
