If a workers’ comp claim is denied, the first step in the appeals process is to file a Request for Reconsideration with the California Workers’ Compensation Appeals Board (WCAB). This form asks the board to review the denial.
Once that’s submitted, the workers’ comp insurance company might decide to hold a hearing. At the hearing, both sides can present evidence—like medical records, witness statements, or anything else that supports your case. This stage is an opportunity to introduce any additional evidence that may not have been considered initially.
If the outcome remains unsatisfactory, the next step is to request a trial before a Workers’ Compensation Judge, where both parties present their case and the judge issues a decision.
If there is still disagreement with the judge’s decision, the matter can be appealed to a higher court. Although the process can be lengthy, persistence in some cases has led to a successful outcome.
