What is the statute of limitations for filing a civil lawsuit in California?

The Statute of Limitations for personal injury and wrongful death lawsuits is 2 years from the date of the incident. The exception to this is when you are filing a claim for personal injury against a Government entity. If a government entity is potentially liable for your injuries, you need to file a claim with that entity within 6 months of the injurious incident.

The Statute of Limitations for medical malpractice is 1 year from the date of the incident.

The Statute of Limitations for breach of a written contract is 4 years from the date of breach, and breach of an oral contract is 2 years from the date of breach.

The Statute of Limitations for property damage is 3 years from the date the damage occurred.
