What steps should a business take if it is sued?

While getting sued is stressful, don’t panic – take it step by step.

First, don’t ignore it.  Lawsuits won’t go away and missing deadlines will only worsen the situation. The sooner you respond, the better your chances of a smooth resolution.

Secondly, call your lawyer. Whether you already have legal counsel or need to find one, getting professional help is key. A lawyer can help you understand your options and better understand what is going on. 

Third, gather your documents. Organize all documents relating to the case, anything from contracts to emails, could be integral to fighting your case. The more organized you are, the better your defense will be. 

Fourth, be mindful of what you say. Even well-meaning statements can be used against you, so make sure to not discuss the case publicly without legal guidance.

Fifth, check your insurance. If you have business liability insurance, contact your provider to see what’s covered. Oftentimes, your insurance may cover legal costs. 

Sixth, focus on a strategy. Most cases do not go to court, usually being settled, dismissed, or mediated. As always, you should discuss with your lawyer to figure out the best course of action.

Lastly, learn from the experience. Once the dust of the case has settled, your company should take preventative measures to avoid future lawsuits, whether that be tightening contracts, updating policies, or improving how disputes are handled. 

If a business is sued, it should confirm the defendants, gather all of its records, call it’s lawyer, and notify its insurance company of the situation.
